Footage from the drone's flight appeared on the internet over the last 24 hours, although the original incident took place over the military sector of Krakow-Balice Airport in March 2014.
Speaking on Wednesday, Piotr Kosmaty of the Kraków Appellate Prosecutor's Office confirmed that the culprit could face up to eight years behind bars.
The prosecutor's office has been leading the investigation since November, together with the Internal Security Agency (ABW).
Unofficially, it has been suggested that a similar incident occured at another Polish airport, probably carried out by the same person.
In the film, a flare is seen shooting down towards the terrain of the airport.
In an unrelated incident, a Lufthansa plane narrowly missed a drone on Tuesday during the former's approach to Warsaw's Chopin International Airport.
A 39-year-old man was interviewed by police on Tuesday, but was later released. (nh)
