The lorry being driven by the unnamed driver hit a speeding Pendolino train in the eastern Czech city of Studénka.
The driver has been accused by Czech police of “creating a threat to public security.”
He now faces between three and 10 years in prison if found guilty.
The Polish consul in Ostrava, Maria Kovacs, confirmed that the number of fatalities in the accident, which occurred on Wednesday morning in the east of the Czech Republic, has risen to three.
"The driver will be charged in the presence of a lawyer, the prosecutor, and an interpreter,” Kovacs said.
She explained that a court will decide over the next 24 hours, whether the man will remain in custody until the hearing, or he will be freed on bail.
The Consul added that the driver is currently being held in Nový Jičín in the east of the country. (rg)
